Twinkle Tales: Terms of Service

Welcome to Twinkle Tales. These Terms of Service ("Terms") govern your access to and use of the Twinkle Tales mobile application and website (the "Service"), operated by Twinkle Tales ("we," "us," or "our").

BY CREATING AN ACCOUNT OR USING THE SERVICE, YOU AGREE TO THESE TERMS. IF YOU ARE A PARENT OR GUARDIAN, YOU ARE AGREEING ON BEHALF OF YOURSELF AND YOUR MINOR CHILD.

1. ELIGIBILITY & PARENTAL CONSENT

Twinkle Tales provides a subscription-based storytelling platform that enables parents and guardians to create, customize, and manage AI-generated stories for their children. The Service is designed to be used by Parents and Guardians to create content for children.

  • Age Restriction: You must be at least 18 years of age to create an account.
  • Verifiable Parental Consent (VPC): By using a credit card or other payment method, or entering your birth year to subscribe, you provide verifiable consent for the collection of limited data necessary to provide personalized stories for your child.
  • Direct Notice: You acknowledge that you have received and read our Privacy Policy regarding the collection of your child's name, personal details, or likeness for story generation.
  • Account Responsibilities: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. AI-GENERATED CONTENT

Twinkle Tales uses generative artificial intelligence to create stories, images, and voices.

  • Nature of AI: You acknowledge that AI-generated content is experimental and probabilistic. It may occasionally produce inaccurate, biased, or inappropriate content.
  • Parental Supervision Requirement: You are solely responsible for reviewing all AI-generated content before sharing it with a child. Twinkle Tales is not liable for content that a user deems frightening, inappropriate, or offensive once it has been generated based on user prompts. Twinkle Tales has put in place stringent filters to create age appropriate content but no filter is foolproof.
  • No Professional Advice: Stories generated are for entertainment only and should not be relied upon for medical, legal, or educational "facts."

3. USER CONTENT & INPUTS

  • Ownership of Inputs: Twinkle Tales retains all rights to the generative photos and text prompts you upload. You retain all rights to uploaded images.
  • License to Us: You grant Twinkle Tales a worldwide, non-exclusive license to process your inputs solely to provide the Service. We do not use your child's personal photos or names to train our public AI models.
  • Ownership of Outputs: To the maximum extent permitted by law, Twinkle Tales retains all rights, title, and interest in the "Output" (the final story). However, you acknowledge that under current copyright law, AI-generated content may have limited or no copyright protection.

4. PROHIBITED CONDUCT

You agree not to use the Service to:

  • Generate content that is violent, pornographic, hateful, or promotes illegal acts.
  • "Jailbreak" or attempt to bypass the AI's safety filters.
  • Impersonate others without their express permission (including using photos of children for whom you are not the legal guardian).
  • Scrape, crawl, or reverse-engineer the Service.

5. SUBSCRIPTIONS, PAYMENTS, AND REFUNDS

  • Third-Party Billing: All payments are processed via Stripe, the Amazon App Store, the Apple App Store or Google Play Store. Their respective terms apply to billing and cancellations. Twinkle Tales does not store raw payment card information.
  • Usage Limitations: Certain features may be subject to monthly usage limits based on your subscription plan. Once applicable limits are reached, access resets at the start of the next billing cycle.
  • Coins & Credits: Virtual currency has no cash value and is non-transferable. All payment, in-app currency, and credits are non-expiring.
  • Refunds: Generally, all purchases are non-refundable. For "accidental purchases" by a minor, you must contact the respective App Store support. Subscription fees are non-refundable for the current billing period. You may cancel at any time, with cancellation taking effect at the end of your current billing cycle.
  • Past Due Accounts: If a recurring payment fails, we may retry the charge according to our payment processor's policies. If payment remains incomplete for more than three (3) days, your subscription may be canceled. Unpaid invoices may remain past due for up to thirty (30) days, during which access to features may be limited.

6. LIMITATION OF LIABILITY & INDEMNIFICATION

  • As-Is Basis: The Service is provided "AS IS" without warranties of any kind.
  • Limitation: In no event shall Twinkle Tales be liable for any indirect, incidental, or consequential damages (including "emotional distress" arising from AI content). Our total liability is limited to the amount you paid us in the last 12 months.
  • Indemnity: You agree to indemnify Twinkle Tales against any claims arising from your use of the Service or your violation of these Terms.

7. DISPUTE RESOLUTION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.

  • Mandatory Arbitration: Any dispute arising from these terms shall be settled by individual, binding arbitration. You waive your right to a jury trial.
  • Class Action Waiver: You agree that you may only bring claims against us in your individual capacity and not as a plaintiff or class member in any purported class action.

8. MODIFICATIONS

We may update these terms at any time. If a change is material, we will provide at least 30 days' notice via the app or email. Continued use of the app after changes take effect constitutes acceptance of the new terms.

Service modifications: We may modify, suspend, or discontinue any part of the service at any time.

9. Termination

Terminations: We may suspend or terminate your account if you violate these Terms. Upon termination, access to the service will cease. If you wish to retain copies of stories generated on the app we will attempt to export them to an email of your choosing, though we cannot guarantee this service. Please reach out to our customer service email to request a copy of your generated stories.
